Objet : Mise en demeure et demande d’accès à l’information
À l’attention du personnel politique récipiendaire de la lettre du 10 mars 2021 à propos du projet de GNL Goldboro,
(Copies conformes aux partis d’opposition, aux journalistes et à des allié.es. Aux journalistes : je suis disponible pour entrevues de 5h à midi demain matin.)
Je suis un honnête militant gaspésien qui travaille sans relâche afin d’assurer un avenir à ses deux enfants : je fais mon possible, sur une base quotidienne, pour empêcher les nouveaux projets d’hydrocarbures fossiles d’émerger.
C’est dans ce contexte que j’ai co-écrit et signé une lettre vous demandant de ne pas accorder un financement de 925 M$ à l’entreprise albertaine Pieridae. Ce financement servirait à :
- acquérir et développer des champs gaziers en Alberta
- acquérir des usines de traitement de gaz grevés d’un passif environnemental gigantesque (c’est devant l’AER, qui a déjà refusé une fois, et le financement fédéral pourrait faire une grosse différence dans la décision du régulateur albertain).
- construire un nouveau pipeline dans l’axe Montréal – Portland
- construire un terminal de GNL aussi gros qu’Énergie Saguenay en Nouvelle-Écosse
- développer l’extraction par fracturation de méthane fossile dans l’Est canadien : en Gaspésie et au Nouveau-Brunswick.
Le Halifax Examiner a par la suite publié un article faisant état de cette demande de financement. Suite à cet article, Pieridae Energy nous a fait parvenir une mise en demeure visant à nous contraindre au silence. Plus spécifiquement, l’entreprise gazière albertaine demande entre autres choses que, je cite :
- vous cessez immédiatement de divulguer les informations confidentielles de Pieridae à quiconque ;
- vous cessez et renoncez immédiatement à utiliser les informations confidentielles de Pieridae à quelque fin que ce soit ;
- vous me notifiez immédiatement, en tant que conseiller juridique de Pieridae, (a) l’identité de chaque personne de qui vous avez reçu les informations confidentielles et les circonstances dans lesquelles vous avez reçu ces informations et (b) l’identité de chaque personne à qui vous avez divulgué les informations confidentielles et les circonstances dans lesquelles vous avez divulgué ces informations ; et
- vous prenez immédiatement des mesures pour atténuer les dommages que vous avez déjà causés, et qui continuent d’être causés, à Pieridae, notamment en rétractant la communication, et vous m’informez immédiatement, en tant que conseiller juridique de Pieridae, de vos efforts d’atténuation.
La lettre se termine par la menace suivante : «Pieridae prend conseil auprès d’un avocat et entamera des procédures pour réparer vos actions illégales dans toute la mesure des droits de Pieridae en vertu de la loi, y compris en demandant une injonction et une restitution intégrale à chacun d’entre vous personnellement et aux organisations que vous représentez pour tous les dommages causés par vos actions.”
La seule information déclarée spécifiquement confidentielle par la compagnie est le montant exact de 925 M$ quémandé au gouvernement fédéral. Je refuse de me rétracter sur ma demande au gouvernement fédéral de ne pas accorder 925 M$ à un méga-projet de méthane fossile, en 2021, sur la base d’un caractère privé allégué par la compagnie. De toute manière, Alfred Sorensen a rendu public, lors d’un appel aux investisseurs le 16 avril 2020, que des négociations étaient en cours afin de mettre la main sur environ 1 milliard de dollars publics canadiens. De 925 M$ ou 1 000 M$, prenez le montant qui vous convient!
Je ne peux de surcroît vous cacher ma surprise quant à l’existence même d’une entente de confidentialité en vue de négocier une aide financière (et à voir la santé financière de l’entreprise, autant dire un don!) de 1 milliard à une gazière décadente.
La mise en demeure de Pieridae est évidemment le prélude à une poursuite bâillon aussi connue sous le nom de SLAPP : Strategic Lawsuit Against Public Participation. Le versement potentiel par quelque entité fédérale que ce soit d’un montant de 925 M$ (pardon, la compagnie exige que je vous parle d’environ 1 milliard de dollars) pour la continuation de l’extraction et l’expansion de la capacité d’exportation de méthane fossile est un enjeu d’ordre absolument public. Le gouvernement fédéral ne devrait en aucun cas accepter de garder le secret sur les tractations en ce sens en vertu d’un “ multi-party non-disclosure agreement dated August 6, 2020 (the “NDA”) which was executed by Pieridae Energy Limited and the governments of Canada, Alberta and Nova Scotia.” De même, votre gouvernement doit s’abstenir de cautionner et de financer une entreprise voyou qui s’en prend à vos citoyens pour avoir dit la vérité sur ce projet dévastateur pour le climat.
Bien que votre silence complet depuis l’envoi de la lettre m’apparaîsse hautement suspect, voire complice, moi et mon organisation vous souhaitons bonheur et lucidité, enclins que nous sommes à croire dans votre volonté à servir le bien commun sans se servir dedans. Je vous demande donc de me communiquer votre position dans ce dossier le plus rapidement possible.
Finalement, en vertu de la loi fédérale sur l’accès à l’information, et puisque je suis sommé de m’y conformer, je vous prie de me communiquer une copie de l’entente de confidentialité entre vous et Pieridae. Tant qu’à y être, pouvez-vous, en vertu de la même loi, me divulguer toute entente conclue entre vos ministères et cabinets respectifs et l’entreprise albertaine Pieridae? Et puis pourquoi pas, toujours en vertu de la même loi, j’aimerais obtenir copie de tous les échanges entre vos ministères et cabinets respectifs et ladite entreprise durant les 18 derniers mois.

Re: Cease and desist letter and access to information demand
To the attention of the political staff recipient of the March 10th, 2021 letter regarding the Goldboro LNG project.
(C.C. to opposition parties, journalists and allies. To the journalists: I am available for interviews from 5am to noon tomorrow.)
I am an honest Gaspesian activist who works tirelessly to ensure a future for his two children: I do what I can, on a daily basis, to prevent new fossil fuel projects from emerging.
It is in this context that I co-wrote and signed a letter asking you not to grant a $925M financing to the Alberta company Pieridae. This financing would be used to:
- acquire and develop gas fields in Alberta
- acquire gas processing plants with huge environmental liabilities (this is before the REA, which has already refused once, and federal funding could make a big difference in the Alberta regulator’s decision)
- build a new pipeline between Montreal and Portland
- build an LNG terminal as big as Énergie Saguenay in Nova Scotia
- develop fracking for fossil methane extraction in Eastern Canada: in Gaspésie and New Brunswick.
The Halifax Examiner subsequently published an article reporting on this funding request. Following this article, Pieridae Energy sent us a cease and desist letter to keep us quiet. More specifically, the Alberta gas company asks, among other things, that, and I quote
- you cease and desist immediately from disclosing the confidential information of Pieridae to any person;
- you cease and desist immediately from using the confidential information of Pieridae for any purpose;
- you immediately notify me as Pieridae’s legal counsel of (a) the identify of each individual from whom you received the Confidential Information and the circumstances under which you received that information and (b) the identify of each individual to whom you have disclosed the Confidential Information and the circumstances under which you disclosed that information; and
- you take action immediately to mitigate the damage that you have already caused, and which is continuing to be caused, to Pieridae including retracting the Communication and you immediately notify me as Pieridae’s legal counsel of your mitigation efforts.
The following threat ends the letter : “Pieridae is taking legal advice and will be commencing proceedings to redress your unlawful actions to the fullest extent of Pieridae’s rights under the law including seeking injunctive relief and seeking full restitution from each of you personally and from the organizations that your represent for all damage caused by your actions.
The only information specifically declared confidential by the company is the exact amount of $925 million requested from the federal government. I refuse to retract my request to the federal government not to award $925 million to a fossil methane mega-project in 2021 based on the company’s alleged privateness. In any case, Alfred Sorensen made public during an investor call on April 16th, 2020, that negotiations were going on in order to get their hands on roughly 1 billion public Canadian dollars. Go with the amount that suits you!
I can’t hide my surprise at the very existence of a confidentiality agreement to negotiate $1 billion in financial assistance (and judging by the financial health of the company, a donation!) to a decadent gas company.
Pieridae’s Cease and Desist letter is obviously the prelude to a Strategic Lawsuit Against Public Participation, also known as a SLAPP suit. The potential payment by any federal entity of $925 million (sorry, the company requires me to tell you about $1 billion) for continued extraction and expansion of fossil methane export capacity is an absolutely public issue. Under no circumstances should the federal government agree to keep secret the dealings in this regard under a «multi-party non-disclosure agreement dated August 6, 2020 (the «NDA») which was executed by Pieridae Energy Limited and the governments of Canada, Alberta and Nova Scotia.» Likewise, the federal government must avoid condoning and funding a rogue company that is attacking your citizens for telling the truth about this climate-damaging project.
Although your complete silence since the sending of the letter appears to me highly suspicious, even complicit, I and my organization wish you happiness and lucidity, inclined as we are to believe in your willingness to serve the common good without helping yourselves. I therefore ask you to communicate your position in this matter to me as soon as possible.
Finally, under the federal law on access to information, and since I am required to comply with it, I ask you to send me a copy of the confidentiality agreement between you and Pieridae. While we’re at it, under the same Act, can you disclose to me any agreements between your respective departments and the Alberta company Pieridae? And why not, still under the same law, I would like to obtain a copy of all exchanges between your respective departments and the said company within the last 18 months.
